Privacy Policy 

Harris Marine Ltd

Effective Date: 24th April 2026

1. Definitions

In this Policy:

  • “Company” means Harris Marine Surveys.
  • “Client” means any individual, company, or organisation engaging the Company’s Services.
  • “Personal Data” has the meaning given under the UK General Data Protection Regulation (“UK GDPR”).
  • “Services” means all marine surveying services provided by the Company.
  • “Agreement” means the Survey Contract, Terms and Conditions, and Scope of Works taken together.

2. Data Controller

The Company acts as Data Controller in respect of Personal Data processed under this Policy.

3. Scope of Policy

This Policy applies to all Personal Data processed in connection with the Agreement, including:

  • Pre-contract communications
  • Quotations and instructions
  • Survey Contracts and Scope of Works
  • Reports and associated documentation
  • Post-contract communications
  • Images and videos 

4. Categories of Personal Data

The Company may process:

  • Identity and contact details
  • Vessel and ownership information
  • Contractual and financial records
  • Communications and correspondence

5. Lawful Basis for Processing

Processing is carried out under:

  • Performance of Contract
  • Legal Obligation
  • Legitimate Interests
  • Consent (where applicable)

6. Purpose of Processing

Personal Data is processed for:

  • Provision of the Services
  • Contract administration and record keeping
  • Communication and reporting
  • Legal compliance and risk management

7. Data Accuracy

The Client warrants that all Personal Data provided is accurate, complete, and up to date.

The Company accepts no liability for any loss arising from inaccurate or incomplete data supplied by or on behalf of the Client.

8. Data Sharing

Personal Data may be disclosed where necessary in connection with the Services.

Where disclosure is made to third parties at the Client’s request or as part of the Services:

  • Such disclosure is undertaken in good faith
  • The Company shall have no responsibility or liability for the subsequent processing of such data by third parties

9. Data Security

The Company shall take reasonable and proportionate measures to safeguard Personal Data.

However, the Client acknowledges that:

  • Electronic transmission of data carries inherent risks
  • Absolute security cannot be guaranteed

10. Data Retention

Personal Data shall be retained for a minimum of six (6) years, or longer where required for legal, regulatory, or insurance purposes.

11. Limitation of Liability (Aligned with Terms & Conditions)

11.1 To the fullest extent permitted by law, the Company’s total aggregate liability arising out of or in connection with the processing of Personal Data under this Policy and/or the Agreement, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to:

(a) the total fees paid by the Client for the Services under the Agreement; or

(b) £5,000 (five thousand pounds sterling),

whichever is the lower sum, unless otherwise expressly agreed in writing.

11.2 The Company shall not be liable for:

  • Any indirect or consequential loss
  • Loss of profit, revenue, business, or opportunity
  • Loss of data not caused by the Company’s negligence
  • Any loss arising from third-party systems, platforms, or communications networks

11.3 The Company shall not be liable for:

  • Cyber incidents, unauthorised access, or data breaches beyond its reasonable control
  • Failures in third-party software, email systems, or telecommunications providers

12. Indemnity

The Client shall indemnify and keep indemnified the Company against any claims, losses, liabilities, damages, or expenses arising from:

  • Inaccurate or misleading Personal Data provided by the Client
  • Any instruction by the Client to share Personal Data with third parties
  • Any breach by the Client of applicable data protection laws

13. Client Rights

The Client retains all statutory rights under UK GDPR, including rights of access, rectification, erasure, restriction, objection, and portability where applicable.

14. International Transfers

Personal Data is not routinely transferred outside the UK. Where necessary, appropriate safeguards shall be applied.

15. Data Breach Compliance

The Company shall comply with its legal obligations regarding data breach notification.

16. Exclusions

Nothing in this Policy or the Agreement shall exclude or limit liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability which cannot lawfully be excluded

17. Amendments

This Policy may be updated from time to time. The version in force at the date of the Agreement shall apply.

19. Acceptance

By entering into the Agreement, the Client confirms that they have read and accepted this Privacy Policy.
